1. What is a personal injury?
A personal injury is a physical or mental injury caused by someone’s negligent or intentional acts. The following are the most common incidents that can result in personal injury:
- Automobile / truck / motorcycle accidents
- Workplace injuries
- Home injuries
- Wrongful death
- Medical malpractice
2. Why should I retain legal counsel if I’ve been in an accident?
Health issues caused by physical injury can take months or even years to develop. Only our experienced personal injury attorney can assess your situation and help you determine fair compensation for your present and potential losses.
3. What is PIP?
PIP is Personal Injury Protection insurance coverage, also known as "no fault" coverage.
PIP provides insurance benefits for medical treatment, lost wages, transportation, prescription medications and lost services to persons injured in a motor vehicle accident.
4. How do I know if I have PIP coverage?
Florida law requires people who own and operate a motor vehicle in Florida to maintain this coverage. In most cases, the declarations page of your insurance policy will show you how much coverage you have.
5. What benefits are available under PIP?
PIP pays 80% of all reasonable and necessary medical expenses that arise out of the use, operation or maintenance of a motor vehicle. This includes medical, surgical, dental, x-ray or other diagnostic services, as well as hospital, ambulance and nursing expenses.
PIP also pays 60% of any loss of gross income or earning capacity caused by an inability to work due to injury (if there is a disability note from a doctor). It also pays for expenses reasonably incurred in obtaining services from others that would have been performed by the injured person.
PIP also pays transportation costs incurred by injured parties traveling to and from locations where medical treatment is received and prescription reimbursement.
Finally, PIP pays death benefits of $5,000 per individual. This coverage is primary over regular health insurance and may have a deductible.
6. What if the accident was my fault?
PIP benefits are paid regardless of who’s fault.
7. What is " Bodily Injury Liability" insurance?
Bodily Injury Liability coverage pays for serious and permanent injury or death to others when you cause an accident involving your automobile. Your insurance company will pay for injuries up to the limits of your policy and provide legal representation for you if you get sued.
In particular, your company pays for injuries caused by you or members of your family who live with you, even if they were driving someone else's vehicle. It may also cover others who drive your automobile with your permission. This coverage also provides you with legal defense in the event the injured party sues you.
8. What is "Property Damage Liability" insurance?
This coverage pays for damages you or members of your family cause (and are liable for) to other people's property in a crash involving a motor vehicle.
