Florida Statute § 767.04 holds dog owners strictly liable when their dog bites someone in a public place or while the victim is lawfully on private property, including the owner’s home. Liability can attach on the very first incident. Florida doesn’t follow the “one-bite rule” used in many other states, which requires proving the owner knew the dog was dangerous before holding them accountable.
Two conditions must be met: the victim must have been in a lawful location, and the victim must not have provoked the dog. A dog owner may assert a “bad dog” sign as a defense, but that defense doesn’t apply to children six years old or younger.
Not every dog-related injury involves a bite. If a dog knocks someone down, jumps on them, or causes them to fall while fleeing, those injuries may support a negligence claim even when strict liability under § 767.04 doesn’t apply. Miami-Dade County Ordinance Section 5-20 generally requires dogs to be leashed when off the owner’s private property, with limited exceptions such as designated leash-free zones. A leash law violation is relevant evidence in that negligence analysis.
