Understanding The Asylum Process

Every year, hundreds of people come to the United States seeking protection from persecution or torture suffered in their home countries. The U.S. Government has implemented a process by which the government determines whether your case has enough merits to allow you and your close relatives to be included in your application to legally stay in the U.S. as a refugee. This is often referred to as the Asylum Process. Because of the high demand of people seeking asylum, it is crucial that you are represented by counsel. The rate of success of a person represented by an attorney is of 46% while parties acting pro se (without counsel) have a success rate of only 16%.

Cancellation of Removal for Legal Permanent Residents or Non-Permanent Residents

Legal Permanent Residents:

Unfortunately, anyone except U.S. Citizens can be removed or deported from the United States. This includes legal permanent residents or green cardholders. However, in most instances before being deported one will be put in removal proceedings. During these proceedings, the government will try to remove you from the United States based on your criminal convictions. Not all criminal convictions immediately make a person removable or deportable.

However, immigration proceedings are complicated in nature. Remember that the government will be represented by an attorney, and so should you. Do not make the mistake to appear before an immigration judge to fight your case on your own. Even though you have the right to an attorney, in immigration proceedings, the government will not provide one for you. It is your duty to find and hire an attorney to help you. We are prepared help you keep your green card and prevent deportation.

Non-Permanent Residents:

People without legal status or documents who live in the United States can have the opportunity to defend themselves against removal or deportation. If the person is successful, he or she can even become a legal permanent resident. These cases can be very complex.
